PLEASE NOTE: AWARDING OF ANY PRIZE IN THIS SWEEPSTAKES IS CONDITIONED UPON THE OCCURRENCE OF THE FOLLOWING EVENT: BEGINNING WITH THE QUARTERFINALS AND CONTINUING THROUGH THE FINALS OF THE 2026 US OPEN TENNIS CHAMPIONSHIPS, IF A MAIN DRAW SINGLES MATCH REACHES A FINAL-SET TIEBREAK, THE SWEEPSTAKES DRAWING WILL TAKE PLACE IF, AND ONLY IF, THE TIEBREAK OCCURS DURING THE SWEEPSTAKES PERIOD. - Eligibility: The US Open Vital Proteins Sweepstakes (“Sweepstakes”) is open to legal residents of the 50 United States and District of Columbia, who are 18 years of age or older (or 19 years of age or older for residents of AL and NE). Void where prohibited. Nestlé USA, Inc., Brandmovers Inc., United States Tennis Association Incorporated (“USTA”), the USTA National Tennis Center Incorporated (“NTC”), the City of New York, and their affiliated companies, representatives, agents or employees (collectively, the “Released Parties”) as well as the immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children and their respective spouses, regardless of where they reside) and household members of each such employee, whether or not related, are not eligible to enter or win. Further, healthcare professionals are not eligible to enter or win. Released Parties are responsible for, and shall be indemnified by, the prize winner against any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession, or loss of the prize. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Participation constitutes Entrant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth in these Official Rules.
- Sweepstakes Period: The Sweepstakes entry period begins at 12:00:00 AM ET on August
17, 2026, and ends upon the occurrence of the first final-set tiebreak in a Main Draw Singles
match beginning in the Quarterfinals, of the 2026 US Open Tennis Championships (the
“Tiebreak Event”), or at 11:59:59 PM ET on September 13, 2026, whichever occurs first
(the “Sweepstakes Period”).
Upon the occurrence of the first Tiebreak Event, the Sweepstakes Period will immediately end. Any subsequent final-set tiebreaks during the 2026 US Open will have no effect on the Sweepstakes and will not result in additional entries, drawings, winners, or prizes.
If the Tiebreak Event does not occur by 11:59:59 PM ET on September 13, 2026, the Sweepstakes will end, and no prizes will be awarded. - Prize Condition: Prize drawings will take place only if the Tiebreak Event occurs during the Sweepstakes Period. The Sweepstakes is tied to the first Tiebreak Event. Any subsequent final-set tiebreaks during the 2026 US Open will have no effect on the Sweepstakes and will not result in additional prizes or prize drawings. If the Tiebreak Event does not occur by 11:59:59 PM ET on September 13, 2026, no winner will be selected, and no prizes will be awarded.
- How to Enter: To enter the Sweepstakes, during the Sweepstakes Period, visit vitalproteins.com/final-set-tiebreak (‘Website”) to find, complete and submit the official entry form by following the on-screen instructions and providing your name, address (no P.O. Boxes), phone number, and email address to earn one (1) entry into the Sweepstakes random drawing. Limit one (1) entry per person/entrant during the entire Sweepstakes Period. Entries must be submitted no later than 11:59:59 PM ET on September 13, 2026 or by the Tiebreak Event, whichever occurs sooner, or will be forfeited. If participating from a wireless device, participant must agree to accept all applicable charges associated therewith. Message and data rates may apply. Participation via a wireless device is designed to work with most of the US major wireless carriers, but Sponsor makes no guarantee that any wireless service provider will participate, and the wireless device that is used must be capable of completing the submission at the Website. Sponsor is not responsible for lost, late, interrupted or other technical issues in connection with submitting an entry or accessing the Website, including but not limited to entries that are not received by the entry deadline for any reason. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the e-mail address associated with the entry at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. No automatically generated or automated entries will be accepted. The use of bots, scripts, macros, artificial intelligence tools, automated systems or other automated devices to enter the Sweepstakes is prohibited and may result in disqualification, in Sponsor’s sole discretion.
- First Prize Random Drawing and Winner Notifications: If and when the first Tiebreak
Event occurs, on the business day immediately following the Tiebreak Event, Administrator
or Sponsor will select 10,000 First Prize winners* via a random drawing from among all
eligible entries received up until the Tiebreak Event. If the Tiebreak Event does NOT occur
by 11:59:59 PM ET on September 13, 2026, no random drawing will be conducted, and the
Sweepstakes will end and no prizes will be awarded. Odds of winning a First Prize depend
on whether a Tiebreak Event occurs and the number of eligible entries received before the
Tiebreak Event.
The potential First Prize winners will be notified by Administrator or Sponsor by email on or about the business day they are selected as a potential First Prize winner (each, a “First Prize Winner Notification”). The potential First Prize winners must respond to the First Prize Winner Notification by following the instructions in the First Prize Winner Notification within 48 hours of Administrator or Sponsor sending or leaving the message, or will forfeit their right to be deemed an official First Prize winner (subject to Sponsor’s sole discretion), and an alternate First Prize winner may be selected at Sponsor’s sole discretion. Sponsor may elect to select up to three (3) alternate winners per available First Prize, and if so, in the event the Sponsor or Administrator are unable to award the First Prize after the initial potential First Prize winner and three (3) alternates, that First Prize will not be awarded. Upon Sponsor’s receipt of each potential First Prize winner’s response to the initial First Prize Winner Notification, that entrant will be deemed an official “First Prize Winner” and receive the First Prize. Neither Sponsor nor Administrator are responsible for lost, unanswered, unchecked, misdirected, or technical glitches associated with the First Prize Winner Notification process. Upon being deemed an official First Prize Winner, Sponsor or Administrator will mail the First Prize to the First Prize Winner. Allow 6 to 8 weeks for the mailing of any First Prize.
*Sponsor reserves the right to award less than 10,000 First Prizes in the event there are less than 10,000 eligible entries received by the Tiebreak Event. - Grand Prize Random Drawing and Grand Prize Winner Notifications: Administrator or
Sponsor will select two (2) Grand Prize winners via a random drawing to be selected from
among all eligible entries received during the Sweepstakes Period on or about September
15, 2026. Odds of winning a Grand Prize depend on the number of eligible entries received.
The first potential Grand Prize winner selected, once verified, will receive Grand Prize #1;
the second potential Grand Prize winner selected, once verified, will receive Grand Prize #2.
The potential Grand Prize winners will be notified by Administrator or Sponsor by email or telephone on or about the business day they are selected as a potential Grand Prize winner (each, a “Grand Prize Winner Notification”). The potential Grand Prize winners must respond to the Grand Prize Winner Notification by following the instructions in the Grand Prize Winner Notification within 48 hours of Administrator or Sponsor sending or leaving the message, or will forfeit their right to be deemed an official Grand Prize winner (subject to Sponsor’s sole discretion), and an alternate Grand Prize winner may be selected at Sponsor’s sole discretion. Sponsor may elect to select up to three (3) alternate winners per available Grand Prize, and if so, in the event the Sponsor or Administrator are unable to award the Grand Prize after the initial potential Grand Prize winner and three (3) alternates, that Grand Prize will not be awarded. Upon Sponsor’s receipt of each potential Grand Prize winner’s response to the initial Grand Prize Winner Notification, that potential Grand Prize Winner will then receive another email from Administrator or Sponsor containing an Affidavit of Eligibility and Liability and Publicity Release (where legal), as well as a Form-W9 tax form (collectively, “Prize Release Documents”). Each potential Grand Prize Winner must complete, sign and return the Prize Release Documents to Sponsor or Administrator within 7 days from the date the Prize Release Documents are sent by Sponsor or Administrator, or will forfeit their right to be deemed an official Grand Prize winner. In the event a potential Grand Prize Winner fails to provide the completed and signed Prize Release Documents within the 7-day deadline, they will forfeit their right to the Grand Prize (at Sponsor’s sole discretion), which may be awarded to an alternate in accordance with the process set forth above. Sponsor will submit an IRS Form 1099 reflecting the actual final retail value of the Grand Prize awarded to proper taxing authorities. - PRIZES AND APPROXIMATE RETAIL VALUES (“ARVs”). Two (2) Grand Prizes (To be
awarded as described in Official Rule #6 above) –
Grand Prize #1: The Ultimate US Open Experience consisting of a trip for two (2) people to the 2027 US Open Singles Finals at Arthur Ashe Stadium located inside the USTA Billie Jean King National Tennis Center in Flushing Meadows-Corona Park in Queens, New York City, NY. Experience includes roundtrip coach-class airfare for two (2) people from Sponsor- approved major airport nearest winner’s residence to a Sponsor-specified airport near or in New York City, two (2) nights’ hotel accommodations at a Sponsor-specified hotel in New York City (standard room/double occupancy); $500 in spending money for ground transportation during the Experience and incidentals from a Sponsor designated gift card provider, roundtrip private helicopter ride for two (2) people to the US Open Singles Finals from a Sponsor-specified location in New York, including car service transfers to the tournament as needed; and two (2) reserved tickets to attend one (1) Sponsor-designated 2027 US Open Finals session, either the 2027 Women’s Singles or 2027 Men’s Singles Finals, as determined by Sponsor (the “Experience”). ARV: $15,000. Grand Prize Winner #1 and their guest must travel on the dates specified by Sponsor in its sole discretion, or Grand Prize #1 will be forfeited in its entirety and go unawarded. Any difference between the stated ARV and actual ARV will not be awarded. Valid credit card is required upon hotel check-in. Grand Prize Winner #1 and their guest are solely responsible for any costs and expenses of the Experience not specified as included in these Official Rules, including but not limited to tips, meals, souvenirs, local and long-distance telephone calls, laundry, insurance, baggage fees, parking, and other personal expenses associated with the Experience. The $500 spending money provided as part of the prize is intended to assist with ground transportation and incidental expenses during the Experience. Grand Prize Winner #1 and their guest are solely responsible for ground transportation to and from the departure airport. Seat locations at the match are at Sponsor’s sole discretion. Sponsor is not responsible for any match delay, cancellation or rescheduling and in the event of such delay, cancellation or rescheduling the Grand Prize Winner #1 will not receive the match tickets as part of their prize and no difference between the stated ARV and actual ARV will be awarded. The US Open schedule of play as well as session dates, number of matches and starting times (and the opening of venue gates) are subject to change by USTA in its sole discretion, and no such change shall entitle winner to a refund or any other remedy if winner cannot attend the US Open (or any session thereof) or for any other reason. US Open tickets are subject to all ticket terms and conditions, as well as all venue and US Open procedures, policies, protocols and mitigation measures, including, without limitation, security and guest conduct, health and safety, and applicable bag policies, and ticket holders must comply and abide by all such terms, conditions, procedures, policies, protocols and mitigation measures. Tickets will be transferred to the Winner digitally via Ticketmaster and Winner must create a Ticketmaster account to receive tickets. No substitution of prize is permitted except that Sponsor in its sole discretion may award a substitute prize/prize component of equal or greater value for any reason. In the event the Grand Prize Winner #1 resides within a 300-mile radius of Queens, NY, ground transportation (or a stipend) will be provided in lieu of airfare and any difference between the actual retail value and the stated ARV will not be awarded. Grand Prize #1 may not be transferred, substituted or redeemed for cash by the Grand Prize winner or any Guest. Grand Prize Winner #1 and their guest must travel together on specified itinerary, including same departure date and return date, or the Grand Prize #1 may be forfeited in its entirety. Grand Prize Winner #1 and their guest are solely responsible for obtaining and traveling with photo identification and any other documentation required for travel. The Released Parties (defined in Official Rule #1) are not liable for any expenses incurred as a consequence of flight cancellation or delay. Helicopter transportation is voluntary and will be provided by a third-party helicopter transportation provider. Helicopter transportation is subject to weather, safety considerations, operator availability and other factors beyond Sponsor’s control. Grand Prize Winner #1 and their guest, if applicable, will be required to sign any required waivers, releases or other documentation with the helicopter transportation provider prior to participation. Sponsor is not responsible for any acts, omissions, or decisions of the helicopter transportation provider, including any cancellation, delay, modification, or inability to provide helicopter transportation. In the event helicopter transportation cannot be provided, Sponsor reserves the right to substitute alternate transportation of equal or greater value, including ground transportation, in its sole discretion. There shall be no compensation or prize substitution if the Grand Prize Winner #1 or their guest is unable to take the trip for the Experience by reason of illness, family emergency, personal events, terrorism, labor strikes, weather, pandemic, or other acts beyond Sponsor’s control. Guest must be at least 18 years of age or older (or 19 if a resident of AL or NE) unless they are traveling with a parent or legal guardian who must be the Grand Prize Winner #1. In the event the Grand Prize Winner #1 decides not to take a guest, no refunds or cash difference will be awarded.
Grand Prize #2: The Ultimate Wellness Investment consisting of a check made out to the Grand Prize winner for $15,000.00, to fund the winner's long-term wellness routines. ARV: $15,000.00.
Federal, state, and local taxes on the Grand Prizes are the sole responsibility of the Grand Prize Winners. A 1099 will be submitted by Sponsor for each Grand Prize to the proper tax authorities. Grand Prizes may not be transferred, substituted, or exchanged for cash by any Grand Prize Winner. Sponsor may elect to substitute a Grand Prize, or portion thereof, for one of equal or greater value at any time at its sole discretion.
10,000 First Prizes – A 10 oz. canister of unflavored Vital Proteins Collagen Peptides. ARV: $27.00 each. Any taxes associated with the First Prize are the sole responsibility of the First Prize Winners. First Prize consists of only those items specifically listed as part of the First Prize. First Prize winner may not substitute or transfer the First Prize or redeem it for cash. Sponsor reserves the right to substitute the First Prize for one of equal or greater value at its sole option. Sponsor reserves the right to award less than 10,000 First Prizes if there are less than 10,000 eligible entries received by the Tiebreak Event.
Maximum ARV of all Prizes available to be awarded in this Sweepstakes is $300,000.00 - Entry Conditions and Release: By entering, each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless the Released Parties from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to an entry, participation in the Sweepstakes, acceptance or use or misuse of any Prize and/or the broadcast, exploitation or use of an entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including, without limitation, reasonable attorney’s fees) arising out of or relating to an entrant's participation in the Sweepstakes and/or entrant's acceptance, use or misuse of any Prize.
- General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, for any reason whatsoever, including, without limitation, any circumstances that impact the occurrence, timing, determination or administration of the Tiebreak Event; fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction or if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. If the Sweepstakes is terminated before the designated end date, Sponsor may (if possible), in its sole and absolute discretion, select the Winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner, and to void any and all entries associated with such individual. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Only the type and quantity of prizes described in these Official Rules will be awarded. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
- Limitations of Liability: The Released Parties as set forth above are not responsible for: (1) any incorrect or inaccurate information, whether caused by an entrant, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical, mechanical, network, typographical, human or other error which may occur in the administration of the Sweepstakes, the processing of entries; the announcement of prizes, or in any Sweepstakes-related materials; (5) any liability, loss, injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt, possession, or use or misuse of any prize. If for any reason an entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. Entrant further agrees and acknowledges that Sponsor reserves the right to forfeit or award any unclaimed or leftover prize at its sole discretion.
- Privacy & Data Collection: Entrant information provided in connection with this Sweepstakes is subject to Sponsor’s Privacy Policy at nestleusa.com/privacy. By entering this Sweepstakes, each entrant agrees that the Sponsor and/or Administrator has the right to contact the entrant via the email account provided in connection with entrant’s entry in order to administer and/or fulfill this Sweepstakes.
- NOTICE OF FINANCIAL INCENTIVE FOR CALIFORNIA RESIDENTS: The Prizes offered under this Sweepstakes may be considered a “financial incentive” under the California Consumer Privacy Act, as amended (the “CCPA”). Generally, Sponsor does not assign monetary or other value to personal information. However, in the event Sponsor is required by law to assign such value in the context of this Sweepstakes, Sponsor has valued the personal information collected and used as being equal to the value of the possible discount or financial incentive provided and the calculation of the value, in this case, is based upon a practical and good-faith effort involving the expenses associated with offering the incentives. The personal information categories collected may include identifiers such as your name, email address, mailing address, state and zip code. By entering this Sweepstakes, you are opting in to potentially receive the financial incentive. Participation is entirely voluntary. You may opt in by following the entry instructions provided. You have the ability to opt out of the Sweepstakes at any time by cancelling your participation in the Sweepstakes by submitting a request to promotions@brandmovers.com.
- Disputes/Governing Law: Except where prohibited, each Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, other than those concerning the administration of the Sweepstakes or the determination of winners or for any disputes arising from the loss or injury from the redemption of a prize, shall be resolved individually, without resort to any form of class action; (ii) any disputes arising out of these Official Rules (except for any disputes arising from the loss or injury from the use of prizes) shall be submitted to final, binding arbitration conducted in Arlington County, VA under the Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services Inc. before a single, neutral arbitrator who is a former or retired Virginia state or federal court judge with experience in entertainment matters who shall follow Virginia law and the Federal Rules of Evidence and have no authority to award punitive damages. Either party may enforce a final arbitration award in any court of competent jurisdiction in Arlington County, VA, including an award of costs, fees and expenses incurred in enforcing the award. Notwithstanding the foregoing, Released Parties shall be entitled to seek injunctive relief (unless otherwise precluded by any other provision of these Official Rules) in the state and federal courts of Arlington County, VA. Any dispute or portion thereof, or any claim for a particular form of relief (not otherwise precluded by any other provision of these Official Rules), that may not be arbitrated pursuant to applicable state or federal law may be heard only in a court of competent jurisdiction in Arlington County, VA; (iii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (iv) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the State of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Virginia.
- Publicity: Except where prohibited by law, the Winners grant (and agree to confirm this grant in writing, if requested) permission for Sponsor and those acting under its authority to use the Winner’s name and entry information for advertising and/or publicity purposes in any and all media now known or hereinafter invented without territorial or time limitations and without compensation.
